Welcome to DeficitFlex ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our mobile application, website, and related services (collectively, the "Service"). By accessing, downloading, installing, or using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service. If you have already created an account, you must delete your account immediately through the app settings and uninstall the application from your mobile device.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service
- The Service is not intended for use during pregnancy or breastfeeding, by people with a current or past eating disorder, or by people whose medical condition or treatment requires an individually supervised diet or weight-management plan. Do not use the Service if any of these apply; seek appropriate professional support instead. Existing users may still access data export and account deletion.
- You must have the legal capacity to enter into binding agreements
- You are responsible for maintaining the confidentiality of your account credentials
3. Health and Medical Disclaimer
The Service is NOT a medical treatment app, fitness program, or healthcare service application. The Service is designed to be a habits and lifestyle tracking application, help you track and build better lifestyle habits through awareness and routine tracking.
The Service is NOT:

What the Service IS:

Important Limitations:

- Do not ignore professional medical advice because of information from the Service
- Calorie estimates are approximations and may not be 100% accurate
- Individual metabolic rates and calorie needs vary significantly

4. User Accounts
You may create an account by signing in with Google OAuth or use the Service anonymously. You agree to provide accurate information and maintain account security. You are responsible for all activities under your account.
5. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Upload harmful, malicious, or offensive content
- Attempt to hack, breach, or compromise the security of the Service
- Reverse engineer, decompile, or disassemble the Service
- Use automated systems to access the Service without permission
- Use the Service for commercial purposes without our written consent
5. Intellectual Property
All content, features, and functionality of the Service are owned by DeficitFlex or our licensors and are protected by intellectual property laws. You retain ownership of content you submit but grant us a license to use, store, and process your content to provide the Service.
6. AI-Powered Features
Our AI-powered calorie estimation is provided for convenience and is not guaranteed to be accurate. Estimates are based on meal descriptions or images and may vary from actual nutritional content. Meal descriptions and images may be processed by third-party AI services (Google Vertex AI).
7. Data and Privacy
We collect, use, and protect your data as described in our Privacy Policy. You own your personal data and may download, export, or delete your data at any time. We implement security measures to protect your data, but no system is 100% secure.
8. Third-Party Services and Links
The Service integrates with third-party services including Google OAuth, Google Vertex AI, Cloudflare, and Sentry. Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services or their privacy practices.
9. Fees and Payment
The Service is currently provided free of charge. We reserve the right to introduce fees or subscription plans in the future with reasonable notice.
10. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, DEFICITFLEX SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Personal injury or death
- Damage to property
- Loss arising from use or inability to use the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
In the event of a refund, we will refund your original payments minus any non-refundable costs incurred, including but not limited to AI token costs for AI-intensive operations processed through third-party services, which cannot be recovered.
11. Indemnification
You agree to indemnify, defend, and hold harmless DeficitFlex from and against any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.
12. Dispute Resolution
These Terms are governed by the laws of Poland, without regard to conflict of law principles. Before filing a formal legal claim, you agree to contact us at [email protected] to attempt resolution. You and DeficitFlex agree to resolve disputes through binding individual arbitration, waiving your right to a jury trial or class action lawsuit.
13. Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate your access for violations of these Terms, fraudulent activity, or any reason with or without notice.
14. Special Provisions for Mobile Apps
If you download the Service from an app store, your use is subject to the app store's terms. You are responsible for ensuring your device meets minimum requirements. The Service may request location permissions or send push notifications, which you can disable through device settings.
15. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes through the app, email, or other communication methods. Your continued use after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.
